These terms govern your use of this website, fastserve.io. They also set out, in plain language, what FastServe is and is not in the relationship between a diner, a restaurant, and us. They are not the commercial agreement under which a restaurant licenses FastServe. That is a separate document between us and that restaurant.
1. Who you are agreeing with
You are agreeing with ACTS9 Matcha (Pvt) Ltd, a private limited company registered in Sri Lanka under company registration number PV 00357034, whose registered name in full is ACTS9 MATCHA PVT LTD and whose registered office is at 16/5 Mohideen Terrace, Ward Place, Colombo 07, Sri Lanka. That company operates this website and the FastServe platform.
FastServe is the name of the product, not the name of a company. There is no separate FastServe entity: in these terms, FastServe, we, us, and our all mean ACTS9 Matcha (Pvt) Ltd, and that is the company any agreement formed here is with. Its registered business email is acts9cafe@gmail.com and its telephone number is 0760602251, while anything about the product or this website is answered at support@fastserve.io.
By using this website you accept these terms. If you do not accept them, please do not use the site.
2. What this website is
An overview of a product, and nothing more. It describes what the FastServe platform does so you can decide whether to talk to us about it. It is not a shop. It takes no orders, holds no accounts, and connects to no FastServe system. Every contact button on it opens your own email program with a message addressed to support@fastserve.io.
3. What is written here is descriptive, not a promise
We work hard to keep the description accurate, and it was written against the product as it actually is rather than as we would like it to be. Even so, software changes. Features are added, altered, and occasionally withdrawn. Nothing on this website is a warranty, a specification, or a binding offer, and no sentence or screenshot here becomes a term of any agreement between us.
If a particular capability is decisive for you, ask us about it in writing before you commit and we will confirm it in writing.
4. Pricing
There are no prices on this website. What FastServe costs is quoted per restaurant, in your own currency, and depends on how you use it. Any figure that reaches you does so in a quote from us, never from a web page. Nothing on this site is an offer of a particular price, and no discount, allowance, or arrangement is created by anything written here. The shape of the billing model is described on our refund and return policy page.
5. What FastServe is in the food you order
This is the part worth reading twice.
FastServe makes software. Restaurants use it to publish a menu, take orders, run their kitchen and their counter, and get paid. We are not a restaurant. We do not cook, we do not handle food, we do not employ or dispatch riders, and we do not deliver anything.
When a diner orders through a FastServe screen, the contract for that meal is between the diner and the restaurant. The restaurant sets the menu, the prices, what is available, the opening hours, and any fees or promotions. The restaurant is responsible for the food, for its ingredients and allergens, for how long it takes to arrive, and for putting things right if something is wrong with it.
Where a restaurant offers delivery, the restaurant fulfils it. FastServe records that an order is for delivery. It does not arrange the journey, assign a rider, or track a vehicle. There is no FastServe courier network.
Money for a meal moves from the diner to the restaurant. FastServe does not take custody of it and never sits between the two. Our refund and return policy sets out what follows from that.
6. Acceptable use of this website
Please do not:
- use the site for anything unlawful;
- try to break, overload, probe, or gain unauthorised access to it or to anything behind it;
- scrape it at a rate that degrades it for other people, or copy it in bulk;
- pass any part of it off as your own, or use our name or marks in a way that suggests we endorse you;
- misrepresent who you are when contacting us through it.
7. Intellectual property
The design, text, code, and branding of this website, and the FastServe software behind it, belong to us or to our licensors. Restaurant names, logos, menus, and photographs shown anywhere in the platform belong to those restaurants. You are welcome to read, print, quote, and share this page. You may not copy the site or the software into a product of your own.
8. Links away from here
This site links out to FastServe product surfaces, and may link elsewhere. Each product surface has its own terms and its own privacy policy. Using one means accepting those, not these. We are not responsible for the content of a website we do not run.
9. Availability
We do not promise that this website is available without interruption or free of error. It is a static overview and we will take it offline to change it. Availability commitments for the FastServe products, where any exist, live in the agreement with the restaurant and not on this page.
10. Disclaimers and liability
This website is provided as it is, without warranties of any kind beyond those the law will not let us exclude.
To the fullest extent applicable law allows, we are not liable for indirect or consequential loss, lost profit, lost data, or lost business arising out of your use of this website, or out of a decision you took because of something you read on it.
Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
If you are a restaurant using FastServe, liability between us for the product itself is governed by the agreement between us, not by this page.
11. Changes to these terms
We may revise these terms. The date at the top of the page is the date of the version you are reading. Continuing to use the site after a change means you accept the revised version. We do not apply changes backwards.
12. Governing law and jurisdiction
These terms, and your use of this website, are governed by the laws of Sri Lanka. Any dispute arising out of them goes to the courts of Colombo, which have jurisdiction over it.
A named country and named courts, on purpose. A clause pointing at the jurisdiction where we happen to be incorporated, without ever naming it, settles nothing and is worse than no clause at all.
If you are a restaurant using FastServe, the agreement between us governs the product itself, and where it names a law or a forum for a dispute about the product, that agreement applies to it rather than this section.
